Terms & Conditions

These terms govern the use of this website and the engineering, infrastructure, build and inspection services provided by AziAl Engineering Infra Tech - FZCO, trading as AziAl Engineering and Infrastructure, in Dubai and across the United Arab Emirates.

These terms and the contract

This website is operated by AziAl Engineering Infra Tech - FZCO, a Free Zone Company registered in Dubai, UAE, at A5, Dubai Silicon Oasis, Dubai, UAE. By using the site or requesting a quotation you accept these terms.

Where we sign a separate quotation, contract, subcontract agreement or work order with you, that document governs the works. These terms apply to the website and fill any gap the signed document leaves open. If the two conflict, the signed document prevails.

Website content is information, not an offer

Service descriptions, project references and figures on this site are provided for information. They are not a quotation, a warranty of a specific result, or a binding offer capable of acceptance. Nothing here creates a contract until we issue a written quotation and you accept it.

Where a page carries a placeholder for a figure, reference or credential that has not yet been confirmed, that placeholder must not be relied upon.

How an engagement runs

Every engagement follows the same sequence:

  • Site survey — we attend the property and inspect the existing conditions ourselves.
  • Quotation — we issue a written quote with a bill of quantity, valid for the period stated on it. Prices are exclusive of VAT unless stated.
  • Pre-approval — materials, drawings, permits and authority approvals are agreed before mobilisation.
  • Final meeting — scope, programme and price are confirmed in writing.
  • Initiation — our crews install, test, commission and hand over.

Anything not listed in the accepted quotation is outside the scope and is priced as a variation before it is carried out.

Client obligations

To let us deliver on programme, you agree to:

  • provide safe, timely and continuous access to the property, including lifts, parking, power, water and any building-management approvals or work permits;
  • disclose known conditions such as concealed services, structural alterations or previous unauthorised works;
  • supply accurate drawings, specifications and unit details, and confirm selections and approvals within the agreed time;
  • obtain owners’ association, developer or landlord consent where the works require it; and
  • keep the site clear of your own contractors where they would obstruct our crews.

Delay, standing time or rework caused by access restrictions, late approvals, changes of instruction or inaccurate information provided to us is chargeable and extends the programme accordingly.

Variations, concealed conditions and programme

Building work uncovers what drawings do not show. Where opening up reveals concealed conditions, non-compliant existing installations or quantities materially different from those surveyed, we will stop, tell you in writing and price the change before proceeding.

Programme dates are estimates made in good faith on the information available at the time. We are not liable for delay caused by authority approvals, utility connections, supplier lead times, building-management restrictions, other trades, or events outside our reasonable control.

Payment

Payment terms, milestones and any advance payment are stated in the accepted quotation. Invoices are payable by the due date shown. Value Added Tax is added where applicable under UAE VAT legislation.

Materials remain our property until paid for in full. We may suspend works on written notice where an undisputed invoice remains unpaid, and any resulting delay or remobilisation cost is for your account.

Snag list and inspection services

A snag list inspection is an independent, visual and functional inspection of the accessible parts of a property, delivered as a written report with photographs and located defect entries. It is provided for a fixed fee, quoted on request.

  • The inspection is limited to what is reasonably visible and accessible on the day. It does not involve dismantling finishes, lifting fixed flooring, opening sealed risers or destructive testing unless separately agreed.
  • It is not a structural survey, a valuation, a certificate of compliance, an approval by any authority, or a guarantee that the property is free of defects.
  • The report is prepared for you and is not to be relied upon by third parties without our written consent.
  • Correcting the defects is a separate, separately quoted scope. Identifying a defect does not oblige you to appoint us to fix it, and does not transfer any developer or contractor obligation to us.

Workmanship, warranty and defects

We warrant that our works are executed with the skill and care expected of a competent UAE contractor, using materials of the specified quality, and in accordance with the applicable codes and authority requirements for the scope.

A defects-liability period applies as stated in the accepted quotation. Within it we will make good defects in our own workmanship at no cost to you. Manufacturer warranties on supplied equipment are passed through on their own terms.

The warranty does not cover:

  • fair wear and tear, or failure to carry out required maintenance;
  • misuse, unauthorised alteration, or work by others on our installations after handover;
  • pre-existing conditions, or client-supplied materials, equipment or designs; and
  • damage caused by water ingress, power events or third parties beyond our scope.

Mandatory statutory liability of contractors for structural and installation works under UAE law applies where relevant and is not excluded by these terms.

Health, safety and site conduct

We work to UAE occupational health and safety requirements and to the site rules of the building or project. We may refuse or suspend any instruction that would create an unsafe condition, breach an authority requirement, or require works to be concealed before they have been inspected and tested.

Liability

Nothing in these terms limits liability for death or personal injury caused by our negligence, for fraud, or for any liability that cannot lawfully be limited under UAE law.

Subject to that, our total liability arising out of an engagement is limited to the value of the fees paid to us under it, and we are not liable for loss of profit, loss of rent, loss of opportunity or other indirect or consequential loss.

Intellectual property and confidentiality

The content, layout, wordmark and text of this website belong to us and may not be copied or reproduced without permission. Drawings, method statements, schedules and reports we prepare remain our intellectual property; on full payment you receive a licence to use them for the property they were prepared for.

We treat your drawings, project information and property details as confidential, and we do not publish project references or photographs without written permission.

Data protection

Personal data is handled as described in our Privacy Policy, in line with UAE Federal Decree-Law No. 45 of 2021 on the Protection of Personal Data.

Cancellation and suspension

You may cancel before mobilisation; costs already incurred on design, permits, procurement and non-returnable materials remain payable. After mobilisation, the value of works executed, materials ordered and demobilisation costs are payable.

Governing law and jurisdiction

These terms and any engagement are governed by the federal laws of the United Arab Emirates and the laws of the Emirate of Dubai as applicable to the works. The parties will first attempt to resolve any dispute amicably. Failing that, the competent courts of Dubai have jurisdiction, unless the signed contract specifies arbitration or another forum.
